With an attempt to further facilitate and expedite foreign investment, Government of Nepal enacted Foreign Investment and Transfer of Technology Act 2019 (the “FITTA” or the “Act”) and Public Private Partnership Investment Act 2019 on 27 March 2019( Chaitra 13, 2075). The FITTA repealed the previous Foreign Investment and Technology Transfer Act 1992(2049). However, due to the delay in the enactment of Rule under FITTA, the Act had not been fully functional. The awaited Foreign Investment and Technology Transfer Rule 2077 (the “Rule”) has been recently published on 11 January 2021 (Poush 27, 2077). The Rule is expected to further enhance the implementation of FITTA.
